Joseph Garner's Will IN THE NAME OF GOD, AMEN. I, Joseph Garner, of Charles County in the Province of Maryland, Planter, beingin health and of good and perfect memory thanks be to Almighty God and calling to remembrance the uncertain Estate of this Transitory life and that all flesh must yeald unto Death when it shall please God to call, do make, Constitute, ordain, and Declare this my last Will and Testament in manner and form following, Revoking and annulling by these presents all and every Testament and Testaments, Will and Wills heretofore by me made and Declared either by word or writing and this to be taken only for my Will and Testament and none other and first being penitent and sorry for the bottom of my heart for my sins and past most humbly desiring forgiveness for the same, I give and commitmy soul unto Almighty God my Savior and Redeemer in whom and by the merits of Jesus Christ, Trust and believe assuredly to be saved and to have full remission and forgiveness of all my sins and that my Soul with my body at the general day of Resurrection shall rise again with joy and through the merits of Christ's death and passion possess and Inherit the Kingdom of Heaven prepared for elect and chosen, and my body to be Buried in such a place and where it shall please my Executor herafter named to Appoint and now for the settling of my Temporal Estate and such goods, chattles, and Debts as it hath pleased God far above my Deserts to bestow upon me, I do order, give, and dispose the same in manner and form following, that is to say, First I will that all my debts and Dues as Favor in right or conscience to any manner of person or persons whatsoever shall be well and truly Contented and paid or ordained to be paid within convenient time after my Decease by my Executor herafter named--- Item, I give and bequeath unto my son, Benjamin Garner, a feather bed and furniture which I hav ealready lent him, also an iron pot and frying pan, also a cow and calf and two flagg bottom chaires
---- Item, I give and bequeath to my son William Garner a Cow and calf
---- Item, I give and bequeath unto my daughter Elizabeth Bobo three barrels of Indian corn

---- Item, I give and bequeath unto my daughter Sarah Garner a negro wench called Rachel, a negro girl called Dinah and her choice of the best bed with the furniture which I have, two cows and Calves, two ewes and Lambs, a horse, bridle and Saddle which she shall choose belonging to me
---- Item, I give and bequeath unto my grandDaughter Ann Gray a negro girl called Eliz'th.
----Item, I give and bequeath unto my sons Hezekiah Garner and Matthew Garner all that Tract or parcell of Land whereon my sons Benjamin Garner and Charles Garner now lives called Williams Purchase beginning at a bonnded red oak at the head of one of the branches of the white marsh about a mile from Richard Carpenders and running North East one hundred and eighty perches to a bonnded red Oak at the head of Daniels branch then South twenty seven Degrees East one hundred and sixty perches to a bonnded red oak at the head of another branch of said Marsh, then down the said white Marsh branch South West by South two hundred perches to a bonnded white oak in the fork of the said branch then by a Straight line to the first bonnd tree containing and laid out for one hundred and ninety five acres of Land, which Land I Will and Desire may be equally divided between my two sons aforesaid Hezekiah and Matthew Garner
---- Item, I give and bequeath unto Charles Garner whom, I appoint by these presents my whole and sole Executor of this my last Will and Testament the Dwelling plantation whereon I now live and my other Estate whatsoever which is not heretofore mentioned to be equally divided between my sons John Garner, Charles Garner, Hezekiah Garner, and Mathew Garner.

On the back of the aforegoing Will was thus written Viz. Charles County to wit the 8th January 1774 Came Daniel McPherson, Archibald Johnson and Thomas Adams, three Subscribing Witnesses to thefore going Will who being duly Solemnly Sworn on the holy Evangils of Almighty God do Depose and say that they saw Joseph Garner the Testator sign and Seale the name and heard him publish and pronounce it to be his last Will and Testament and that at the time of his so doing was to the best otheir apprehensions of sound and Disposing mindand memory and they severally Subscribed as Witnesses to the said Will in the presence of the Testator and at his request which probat was taken in the presence of William Garner the heir at law who did not object to the same---- Before Dan'l.
